Casual Workers under the Workplace Safety and Insurance Act

Michael Zacks, of the Office of the Employer Advisor at the WSIB, recently issued a notice to employers regarding the use of "casual labour." A recent case out of New Brunswick is a reminder of how employers must be diligent if using company money to pay for work. The OEA advises employers to always obtain a clearance certificate to ensure the individual doing the work is a worker under the WSIA, and thus not able to sue for negligence resulting from an injury.
