Construction Lien Act Review – Requesting for Your Feedback

Phase 2 of the provincial review of the Construction Lien Act (CLA) has now been launched. The objective of this review is to provide the Government of Ontario with independent, third-party legal advice on how the CLA should be reformed in order to better achieve sound policy outcomes for the construction industry in the province.

We are now looking for your input on how the Lien process should be reformed. Please click on the following link - https://www.surveymonkey.com/s/NLGXD7K - to provide feedback to specific areas of the review, or simply to provide your general thoughts on areas that are in need of reform.

Phase two of the review process launched with the publication of the attached Expert Review of Ontario’s Construction Lien Act – Information Package. The document is preliminary and meant to set the stage for understanding what the various opinions are on the issues being explored during this review. The Information Package considers 15 separate categories of issues (e.g. Holdback and Substantial Performance, Alternative Dispute Resolution, Exclusion Provisions, Proof of Financing, etc.) in order to gain a wide range of opinions from all sizes of contractor, supplier, and owner.
