As part of the OSWCA advocacy efforts (alongside ORBA and the Ontario Waste Management Association) to adjust some of the shortcomings of the provincial Commercial Vehicle Operator’s Registration (CVOR) system, the MTO is proposing amendments to Ontario Regulation 596, which prescribes threshold value for reporting property damage collisions for the purpose of the HTA section 199, subsection (1). The proposed change will increase the property damage reporting threshold from $1,000 to $2,000.

A Property Damage Only (PDO) collision includes any vehicle collision in which no person sustains bodily injury, but damage is sustained to public/private property (including vehicles and their loads). The dollar threshold refers to the total value of property damage to vehicles and property in a collision.

The PDO collision reporting threshold (currently $1,000 in Ontario) is what police officers/enforcement agencies use to determine whether a non-fatal/non-injury vehicle collision should be reported to the Registrar of Motor Vehicles as required under the Highway Traffic Act (HTA). Ontario's PDO threshold of $1,000 has remained unchanged since 1998 as this dollar-based threshold is not indexed to inflation. Due to a variety of factors (inflation, the increased number of registered vehicles, evolving automotive technologies, etc.) a collision resulting in $1,000 of vehicle damage in 1998 was likely more severe than a collision resulting in $1,000 of damage today.

Although the impact of this proposed change on a company CVOR record will be minimal, this is a first step towards revising the system to be more equitable and up-to-date.
